Crimes in Tennessee include both felonies, which are more serious offenses that carry a jail sentence of one year or more, and misdemeanors, which are less serious and can carry penalties up to eleven months and twenty-nine days in jail.
About Crime
No act is a crime if it has not been previously established by statute. Under the law, you must have notice that whatever you are doing (or are failing to do) is a crime before you can be held criminally accountable. Each statutory crime consists of very specific elements. For example, in a DUI case, the driver must be (a) in physical control of (b) a motor vehicle while (c) under the influence of an intoxicant. If any one of those elements are missing, no crime has been committed.
Unfortunately, in our society, judges and juries are all too often to skirt their responsibilities to make sure the prosecutor has met the required burden of proof beyond a reasonable doubt. That’s why you need an excellent, experienced and qualified attorney to represent you or a loved one if you do find yourself accused of a crime.
